Mark (LossMitPro) and Duane, please back off

To: Duane and Mark.

After sleeping on this whole thing and seeing how you Duane continue to break my trust and STILL talk crap about me in public and interfering in my marriage, even after you told me you will stop, and how you Mark continue to bully me with your frivolous use of the legal system…. my decision is as follows:

I am canceling all agreements I’ve ever had with you about my domain or the “settlement” [which was really done to get Marty off my back (I’ll settle with Marty myself)] or anything else you may be expecting from me. I’M OUT!

I don’t want to make a big scene out of it.

I thank you for the help in the past. Even though I HATE your tactics, I was willing to cooperate lately believing you have my best interest at heart, but obviously we all are not meant to work together in any capacity. For my side, I also ask for forgiveness for any hurt or pain I may have caused you guys in the past [on a personal level].

Regardless of your intent, your actions show me that you are trying to screw me. Even if you’re not trying to, the way you treat me I think is not right. If I sell this domain to you Duane I will have to deal with you and Mark for a year. I do not want to do that. I’m done with my emails being plastered and my trust being violated and Mark’s bullying me around.

At this point I just want you both to please BACK OFF and go away from my life. You both know I don’t owe you anything. Any cost you Mark may have incurred was as a result of YOUR abuse of the legal system. You DID NOT have to sue me. You could have asked me to remove your posts [with your real name] and I would have done that like I did in the past.

Now please respect my decision, show me some human courtesy and please walk away. I don’t want to be enemies but we can’t be friends either. So lets just forget about the whole thing and move on with our lives.

    That’s the best post you’ve ever written Casey. I think you’re finally becoming a better businessman! M*** is going to throw more ‘legal eagle’ emails at you. Just ignore them and get a restraining order. He’ll try to take you to court again. Don’t even show up. They can’t seize any of your assets because you don’t have any.

    Might I suggest you set up a meeting with G to find out if she’s willing to work things out when you pay off her debt. In the meantime, monetize the heck out of this blog and give her every cent, and/or sell it as originally planned. You can still build it up for a couple months then sell when the revenues are flowing again.

    That’s crazy. If you make a commitment to behave in a certain way, then that’s the way you behave… even if, three days later, you decide that it’d be inconvenient or foolish.

    2) Is the Foreclosure Code book now back on?
    3) Has Marty threatened to sue you?
    4) Are you still planning on getting a W2 job?

    While I can understand that you don’t want to feel pressured or bullied (not saying that’s what they are doing, only that being bullied is how you feel right now), I hope that you ultimately come to realize that getting out of the blog game is in the interests of your legal situation, G, and your future happiness.

    I doubt that will happen Casey- Mark & Duane seem to be having too much fun with their 15-minutes of fame as evidenced by their last podcast. I can’t believe your wife was on that call standing by and letting these people rip into her husband- regardless of your mistakes this seems like a huge betrayal. It seems like your marriage is circling the drain and may not be salvaged at this point. I’m very sorry about this and recommend www.dailystrength.org as a great site to find emotional support anonymously.

  • I hope people see that I’m being very reasonable here… there is absolutely NO business between Duane and me or Mark and me. Our business stuff has been over a LOONG time ago. Things didn’t work out, so we didn’t they leave it at that?

    Why did they continue coming back to the hater sites and continued being part of the drama. Not only that, now they are LEADING the drama by scheduling talkcasts to talk trash about me. What did I do to deserve this?

    Why are these “BUSINESS MEN” getting involved in all this on a PERSONAL level? The have absolutely nothing to gain out of this. Or DO THEY?

    I was willing to cooperate as you can see from my last talkcast. I just wanted the whole thing to be over. The BS “settlment” and sale of the domain was their idea for me to get Marty off my back (I should have never done it like that, it wasn’t very fair to Marty either).

    But keep in mind, selling the domain and pulling the plug on this whole thing was MY idea. They wanted me to do this for a long time and I finally came around but not because of them. The primary reason is I don’t want to lose my wife, all this publicity has been hurting her from the start and I didn’t see it. Duane and Mark where telling me the same thing and that’s why I was always willing to listen to them because in a way I though they might be right.

    So the domain sale was arranged by Mark after talking with Duane. I appreciated the offer at that point and I was even OK at the time with giving Mark a “commission” out of the sale. He insisted on doing a “contract”.

    I trusted them again (WHY DO I KEEP DOING THIS???) and figured this is my best way out. I wanted to get my wife money, sell the blog and get out of this whole mess.

    If this “settlement” was a way to do it, so be it.

    But now I see this whole thing is being used to screw me. I see how Duane acts even after promising to to do an “internet truce” and no more talking about me online.

    I was REALY REALLY upset at Duane in the past for violating my privacy and plastering all those emails, and WORSE positioning himself as a means for my wife to get back at me via the internet.

    I don’t blame my wife, she was upset at me and I’m the one to blame for starting this whole blog. However, what REASONABLE person will put himself in the middle of a struggling marriage?

    And Mark’s frivolous lawsuits, and violating my copyright and plastering the audios… don’t get me started.

    You heard me on the last podcast though, I was actually cooperating with everybody because I was willing to look past all those issues.

    But those issues keep coming back.

    Duane keeps talking trash and treating me like crap. (I walk away from my computer for a few hours and he thinks i’m canceling our agreement and sends me like 10 threatning emails every 15 mintues then pulls out… and THEN ON TOP OF ALL THAT calls for a podcast with the haters and talks more trash, after PROMISING an internet truce to me the night before. )

    Mark, keeps throwing his legal stick around and if you remember he was provoking Marty to sue him by posting our copyrighted audios. Mark just wants to pick a fight and can’t sit still.

    Mark you keep telling me about this “spiritual connection” but its hard for me to connect the words with actions dude! Why bully people just ‘cuz you have some personal issue with them. WHY DIDN’T YOU JUST WALK AWAY (after our business relationship didn’t work out)?????

    I didn’t provoke you I didn’t attack you I didn’t do ANYTHING after we had a falling out. Why did you keep rallying up the haters against me? What? You wanted the best for me? Come on dude, that doesn’t make any sense. The lawsuit was used to get all this mortgate crap exposed in court and that’s what you told all the haters.

    I was willing to OVERLOOK all that stuff… everybody is a witness of that. I was willing to forgive.

    Look, I know I’m NOT INNOCENT HERE.

    I know I WAS THE ONE who got this whole mess started. Yes, you don’t have to keep rubbing it into my face.

    Now I see how toxic this whole thing got and I’m trying to walk away.

    I have bigger issues to worry about, like FBI.

    I need money for a criminal defense attorney and Mark knows that. I don’t have money to defend myself against Mark’s stupid lawsuits. I wish I did because I’m tired of being bullied.

    But anyway, i’m done whining here.

    Sorry if this whole thing has been repetitive. I’m just sitting here, its Sunday night, I had a little bit of time to TRY to relax but it was hard to do. All this stuff is on my mind and I can’t get any peace.

    I’m kind of just dumping my thoughts and feeling here, hard to keep it all bottled up.

    One of the worst parts is that the person I long to speak with the most, I haven’t been able to. It’s all my fault. I should have never done this whole publicity this way. Now I have to reap the consequences. But I just wish the people who SAY they want to help me, would just BACK OFF and quit making things worse.

    Man, this whole thing is so tough… and it’s lonely. I hope I don’t regret dumping all these thoughts here, after I wake up tomorrow. But for now it feels better. The blog has been sort of like therapy, in a way.

    I have a question for you Casey.

    The email (and blog post) from a few days ago stated that you were closing down the blog because you want to fix things between you and your wife. You also had the deal with LMP and Duane, which stated you HAD to close down/sell the blog.

    After tonights podcast, it seems your w**e will not be taking you back. (Did you know she was listening to the podcast, and also commenting on EN? I got the general idea from things she was saying to Duane that she will NOT be taking you back, under ANY CIRCUMSTANCES.)

    Now, you are saying NO DEAL to LMP and Duane (Best thing you have done, by the way!).

    So, does that mean you will keep the blog up and running?

    I hope tomorrow goes better for you. I doubt they are going to go away quietly, unfortunately.

  • That “legal stick” will be beating you hard, Casey. Ooops! Next lawsuit, and I’m sure there will be more, consult with an attorney before signing a settlement agreement! Unlike, perhaps, a car sale, there is no “cooling off” period on a settlement, and it is legally binding. You’re an adult, and you have to deal with the consequences of your decisions. If you don’t, the judge will make you.

  • hobbit, we all know your ideas on contract law, but in the real world to amend a contract requires both parties to come to an agreement. What you are doing is called ‘breach of contract’.

    I hope that when/if you sell this blog that you will set aside 50% for your defense and 50% for your other half.

    You are right, this situation is toxic, from the start and more so today. I think it is noble that you want to take care of your other half, but you have to take care of yourself too.

    In the end, marriage is 50/50 and so should your blog sale or whatever you decide to do. Don’t let the others get in the way. Whatever you get, whether it’s link sales, supportz or a total sale of this blog, send 50% over to your other half. Don’t go through those guys. Don’t ask her first. Just send it. If she doesn’t take it, send it to her attorney (if she has one).

  • Selling the domain for cash was a good idea. All you need is one cash buyer per year + the ad income and you’re set. Just resell the domain over and over again! Heck, if you’re really smart, you can sell Mark’s website, sell the CaseyHaterz site, sell Nigel’s SLC site!

  • And now I see and hear that Mark (LossMitPro) is trying to screw up my domain sale any way he can. Why is this guy so hateful towards me? I did NOTHING to him after our business relationship didn’t work out. He has ALWAYS been on the attack mode.

    And I can’t believe the guy is spreading false rumors that I’m gonna leave the country or run away or some crap like that. I need a freakin’ defense attorney and I have a right to try to sell the blog to the highest bidder and ONE THAT I’M COMFORTABLE in order to raise some money for myself and have money to give to my wife too.

    The key is selling to a person i’m COMFORTABLE with. The thing is I was comfortable with Duane ONLY because my wife seems to trust the guy (why I don’t know, but anyway) and I know should would have been happy.

    But I just refuse to be mistreated by Duane and Mark the way they have been. Waiting a year to collect 50% revenue and putting up with these bullies controlling my life is something i’m NOT willing to do, sorry.

    Also, looking back, the “creative” settlement was not the right way to treat the only person who IS losing money and getting screwed over by me, my publisher Marty.

    I went along for the time because Marty himself used bully tactics on me when I first tried to pull down the blog. But honestly I also didn’t REALLY want to shut down so I was using Marty’s lawsuit threats as an excuse more or less.

    However, the treats where real and I don’t know what Marty would have tried to do for sure. I didn’t want to deal with that and didn’t want to put my wife through additional crap.

    Also, he was gonna publish the book without me. And I have a weak spot for making profits from my publicity so that was another carrot.

    It was still my fault for NOT shutting down for good the first time. I’m sorry for using Marty as an excuse. I could have stood up to him his bully tactics and threats of a lawsuit (he reminds me of Mark in that regard).

    So this settlement was going to be a creative way to get Marty out of the picture because by assigning the book rights to Mark, then Marty would have to deal with Mark directly.

    Mark always wanted to attack Marty. Mark didn’t like the fact that Marty came in between me and my wife when I first tried to shut down. Mark needs to realize though is that the MAIN reason wasn’t Marty, it was ME. I was the one that couldn’t put the blog down.

    So Mark has been looking for a way to pick a fight with Marty ever since then. That is what I meant that Mark is interfering with my marriage. He didn’t like how things went down and he saw Marty as the bad guy. Mark thinks Marty doesn’t care about my marriage and my wife. So as a result Mark has always been upset at Marty.

    While I appreciate Mark looking out for me and my marriage, I DO NOT APPRECIATE him trying to pick a fight with Marty. That’s what stealing our copyrighted book audios and plastering them on his website was all about. So when I accused Mark of interfering with my marriage on the podcast before last, that’s what I was referring to.

    And that is why Mark got so pissed off and threatened to “go for my F’ing throat” or something like that. Perhaps it was a communication as he thought I was saying that Mark is DIRECTLY interfering with my marriage. Because, the fact is, YES Mark is no longer communicating with my wife, as far as I know.

    However, the WHOLE PREMISE of going after Marty was due to a personal issues related to Marty’s treatment of my marriage. Mark didn’t like it and figured its his place to throw his legal stick around. Well MARK, ITS NOT YOUR PLACE! Please understand that. I appreciate your intent but YOU’RE DOING IT IN THE WRONG WAY.

    Do you guys see how complicated and convoluted this whole mess is?

    I’ve been talking with Marty directly and we’re working out some kind of a settlement. I’ve screwed marty by backing out of the contract but I also hope he doesn’t fight dirty.

    Having said that Marty has been the MOST reasonable “character” in this whole end-of-the-blog drama.

    I talked with him and he just wants his HARD expenses covered. He is willing to walk away from the whole thing, forget the book, absorb the lost time and energy and just be done with the whole thing.

    I wish every would be willing to do the same.

    I agree with you that getting away from D&M is probably in your best interest–which is why I didn’t understand why you consented to the settlement agreement last week. Have you ever honored a contract with anyone?

    The lawsuit settlement with LMP is the NLL ladies thing all over again: you do something contrary to your interest on an impulse, and then abruptly pull out of it when you change your mind on a whim.

    Don’t you understand that there are consequences for anything and everything that you do?

    I’m not hating on you, I still just don’t understand how your brain works despite following this saga for nearly a year.

Mark will continue to sue you and Duane will continue to go after G***** .

    1) Hire a lawyer somehow to fight Mark. You have to do it or he’ll crush you. Get anybody.

    2) Fight Duane, literally. He’s coveting your wife man. To restore her honor you’ll have to call him out. If it was my wife you god damn better believe I’d have that French fairy LeGate rolling on the ground in agony.

  • Casey, I think you’re doing the right thing. I am not a supporterz, but I have to say that the behavior of many of these people around you (including some of the Haterz) makes me sick. Especially the ex-partnerz. I think they’ve pretty much all screwed you over or tried to, and the ones who try to interfere in your marriage make me especially ill.

    Why did you sign off on the settlement agreement to assign the rights to FC if your JV agreement clearly states that you may not do so (according to Marty)? Did you not understand that was a clause in the contract, or did you just not care?

  • Just surfed over to myebid.com and it looks like you’re being spammed with bids. If you’re serious about selling, find a reputable domain-sale site, and one that includes pre-approved bidders. Even eBay has pre-approval configurations. Continue to sell advertising in the meantime (new banner ad, etc.) so you can earn some $ and give it to G.

  • Looks like Marty posted a statement on the Foreclosure Code site. I’m glad he is telling his side of the story. It’s all coming to an end and its good to bring EVERYTHING to light.

    It answers so many questions and provides new and interesting story lines. X-files ran with it for several years, you should be able to keep interest with a similar time period.

  • So you are still considering selling the blog or shutting it down? Please, Casey, keep it: it’s the only asset you have. As for the book deal, it was a very good deal, for reasons posted on the foreclosurecode.com site. You should beg Marty not the break the deal with you and do what he says (he’s the one who wants out now). It was the blog sale and the lawsuit settlement that were bad deals, but the book was a great deal and was going to bring you some money.

    Now that you can see that your efforts to please somebody in particular are fruitless, you should no longer feel that you can’t have a blog or a book. But if there is any chance that paying off debt will eventually help, pay from book sales and advertising revenues, and from your W-2 job, which you can have at the same time. Don’t just sell the blog to get a larger sum at once. Anybody who wants you to do that either can’t even understand that it’s not a good idea, or just wants to take your money and run.

    As many people have pointed out, the FBI wouldn’t just warn you or call you. They would come and see you and possibly arrest you. Don’t retain a criminal lawyer if you are not actually charged with anything. But should it come to that, you would probably be represented for free, since you can’t afford to pay.

    Here is your problem: You were invited to fight with the tarbaby and you agreed to it.

    You agreed to a Stipulated Agreement. That means you must fulfill that agreement. Failure to do so means you can be taken back to court to force you to live up to your end of the agreement, whether you like it or not. Failure to do so means you will be in contempt of court and can face fines or jail time.

    You are stuck with the stipulated agreement unless you can go back to the judge and have the judge change the agreement. You cannot ‘adjust’ or ‘back out’ of this agreement without the judge’s permission. Failing to live up to the agreement means there will be real consequences this time around. Since LMP is not wasting any time going back to the court house, he feels that you are violating the agreement in some way. The easiest thing to do would be to find out what the perceived violation of the agreement is and correct it.

    Translated: You walked into this one and are now being forced to live up to what you agreed to. You may not like it, but you are going to have to do it. If you are sued over this (and it appears to be coming), I expect the judge to be much less amiable and will start having some very pointed questions. The judge will expect you to answer the questions in short, clear answers that are not ambiguous.

    If you want to consider me being a hater you can. All I am doing is trying to give you my unvarnished opinion of your problem, warts and all.

    …such as the way the deal collapsed thanks to multiple contractual violations on your part. I was genuinely surprised at this: I assumed it was just your violation of the NDA, but it seems to go far, far deeper than that.

    I know I’ve asked this before, but do you genuinely not understand that a contractual arrangement is more serious and binding than a playground agreement? Going from your actions over the past 48 hours, it seems not - and yet this is just about the most basic business skill of them all.

    What really baffles me is that you’ve seen time and time again what happens when you breach contract (you’ve even been sued!), yet you still keep doing it! Is it some mad compulsion inside of you? Do you genuinely believe that you’re so important and special that ordinary rules don’t apply to you? And do you despise your partners that much that in many cases you start breaching the contract when the ink is still drying on the paper?

    For all my snark, I do feel genuinely sorry for you, Casey. Something has seriously arrested some aspect of your development, with the result that you’re still essentially a teenager trying to talk tough with the big boys. Predictably, it’s been an utterly calamitous disaster for you, but most people might have learned something by now. The really bewildering thing is that I’m not sure you have.

  • I can’t believe you would lose everything just when success was right around the corner. You were making money with your blog and were likely to make money with the book but somebody else made you shut down the blog, which you referred to as your “baby”, and lose advertising money. It looks like you lost, or are about to lose, the book money, too, and for the blog, instead of getting lots of money, you were thinking of selling it for 100k, sold it for 20k but that did not work out, and now you may sell it for next to nothing or lose it all the way, especially since you now want to sell just the domain and lose the content. The domain may not even sell for much, since some very similar domain names were available for relatively little money very recently (see the private emails from me). So you threw away your opportunities to succeed in business for the sake of somebody else who won’t even talk to you.

  • It’s a shame the sale fell through. The domain is possibly worth more, but if you just sell it to a random buyer there is a good chance that they will just park it with PPC ads. Did you assign the ownership to LMP? It is good to see that you are keeping to your word of shutting down the blog. I think that all of the haterz will disappear once the site is gone. I don’t think that there is any way of mending your relationship until you leave the public eye.

    He’s essentially admitted that the sale of the blog to Duane was a scam that LMP and Duane proposed to him as means to get rid of the publisher. The money he agreed to pay to LMP was a commission for the sale of the site to Duane, not some fee ordered by a judge.

    According to his post, the three of them were trying to scam the publisher together.

    Think it through - why would Duane and Mark conspire to help Casey get out from the contract with M****? Casey can ignore that contract as easily as he has ignored the rest. Duane and Mark don’t get any benefit by defusing M****. M***** hasn’t sued anybody as far as I know, nor has threatened to sue anybody.

    $20K is far more than the domain and blog combined are worth. The deal makes sense at face value - Duane spends $20K to help _G*****_ who is the one who needs help, (not Casey, who needs a big walloping from his H***** C*rp*rati*n former guarantor), Mark gets his out-of-pocket expenses back and Casey avoids one lawsuit.

    The only person who believes that Duane and Mark are acting in Casey’s best interest is Casey himself. He could easily spin that up into a fantasy about the three of them scheming to throw M**** under the bus. That’s Casey.

    Casey’s best interest is to be taken to a quiet sanitarium where he can do sweet deals with the other inmates during “TV Room Time”. But we’re not there yet. Until that time, Casey’s schemes have to be shut down. No more manipulating G*****, no more borrowing, Casey must get a job and learn to work for a living.

    Casey, here’s some advice and I hope you will at least consider it:

    Do not talk to Mark. Do not call him. Do not email him. Do not have dinner with him. And, by god, don’t ask him for advice. Regardless of what he says, *none* of what he is doing is helping you in any shape or form. The guy is creepy and his obsession with you is bordering on stalking.

    Do hire a real lawyer. This can be costly, but the alternative could be much, much worse. Once you have a real lawyer Mark will think twice about continuing his legal action. He’s a collector and is good at getting money out of broke saps who can’t even afford legal represantation. You’ve been playing right into his hands. Don’t keep making the same mistake. You know what happens to bullies when they meet their match? They back down. As long as you are a weak, soft target he will continue to “go for your throat”.

    The stuff with Marty is another huge mess you’ve created. He *will* publish your book with you or without you. If you ignoring Marty is your way of trying to stop the book from being published, it was the worst way to accomplish that. I don’t know exactly what’s going on between you and Marty. Maybe you’re having second thoughts about forking over the $4000-5000 to him. Either way, it sounds like the book will get published, and your only choice is whether it gets published with you or without you.

    Your past transgressions aside, I really do hope you pull through your current mess.

    Why spend your time looking for an attorney when it can be provided to you at no cost?

    Because Casey needs a good one to help sift through this gargantuan mess. And he needs to be proactive about this - waiting for the court to appoint someone is worse than useless.

    The fact is that Casey’s chickens are now coming home to roost. Ever since his notorious “NO DEAL!” post back in January, he’s shown a complete inability to understand why written contracts are more important than vague promises. And despite a gazillion and one posts trying to explain this to him, as well as an actual court appearance last week, he STILL doesn’t seem to get it.

    Which is why he’s heading for a whole world of legal pain, and needs to appoint a lawyer right now to pore over every piece of paper he’s signed over the last year. And that lawyer has to be blunt about the damage he’s done. And Casey is somehow going to have to bite his lip and not call the lawyer a “hater” - because this person is just about the only chance he’s got to avoid a hefty fine or jail sentence.

    Maybe Casey should sell because along with the other “casey sites” have nothing to do with the housing market and everything to do with his personal drama.

    The problem I see is this IAFF has nowhere to go except to continue entertaining those already following the story. I really can’t see anybody just tuned being that interested. And the book deal? Who outside of those now following the story would be interested in buying this book? And why would anyone following the story want to pay for it when they already know what’s going on?

    My advice would be to sell the blog to the highest bidder and to make sure that Casey controls the money.

    Get LossPro and Duane out of the picture as soon as possible.

    And Marty?

    If he’s he’s foolish enough to put out a book or tapes fine. Let him. It’s only going be sold over the internet and if his self-publishing company recoups its’ expenses and makes a few bucks great because that’s the best that’s going to happen.

    1. Get a lawyer immediately
    2. Download copies of all of the TalkCasts where Duane and Mark were involved. (including those done by Haterz and Duane’s from last week. There is solid evidence in at least a couple of them to get both Mark and Duane into enough hot water legally that they may not have time to mess with you.)
    3. Print out copies of any comments/posts that you know were done by Duane or Mark on this site and others.
    4. Read some of the comments from the last few days from some of the other users. Specifically on the “Bunch of Crazy Crap” post. There was at least one there that offered some solid ideas.

    I don’t support what you’ve done in the past and in fact it pisses me off what you’ve done, but Mark and Duane really did step over the line in more ways than one. Best o’ luck kid!

    Casey, if you want to self publish your book, you can self publish for much LESS than FOUR THOUSAND dollars.

    An average fiction print run is 5, 000 books. Most books DO sell more than 100 copies, unlike Marty’s written statement.

  • Casey, it took a while but you are finally seeing things clearly. Those two are not in your corner. I doubt they ever were from the start.

    I don’t buy it when a stranger says they want to help someone out of kindness. They went into the deals looking to make some money. That is understandable. That is normal. What isn’t normal is how they reacted when their deals broke down.

    These two “adults” are the most vindictive, spiteful, hateful, stalkers I’ve ever read about. They have been trash talking about you all over the internet for months. They are involved in your personal life, egging your wife and family members on. Turning them against you! Even making up BS lawsuits to add stress to your life.

    You are better off shutting the blog down and making $0, than to be involved with those two any longer.

    If you really are in trouble with the FBI that really sucks. You made mistakes, but I don’t think you are a criminal.

    I do agree with those who say that some of these men want to bury you and some want to take your wife. There are obviously reasons for both. Your first priority should be your wife. As stated in #58, you need to call your wife NOW and tell her what an idiot you have been. Resolve to make things right with her, it seems like you may be trying to do just that by selling the domain name. Seek council of people that ACTUALLY WANT TO HELP YOU. This doesn’t mean idiots like Mocha with the whole “Yo, yo Casey ma Boy! I’z a suppotta!”. I really doubt that people like that will do much for you. I know, for a fact, that over the last year that you have had legit offers to help get you on track, but it seems as though you only seem to seek out the slimeballs. One possible reason is that these people tell you what you want to hear and the people with the sincere offers don’t paint such an exciting picture.     What is going on with the Haterz site? Are they really imploding? It did seem like EN was abandoned and people went to the board. EN’s traffic died, then Rob ‘Dawg’ accused someone of insulting his daughter and now he has three Casey top posts a day.

    Anyway, Casey this site is valuable not because it is about foreclosure- it is valuable is because you are an interesting character. Sell the site for whatever you can and become a tech blogger. Or blog from your cube.

    It wont matter what subject you choose. In a couple of months you will be back to a couple of grand in sweet semi-passive income in addition to your W2, even if you just did movie reviews or talked about juice bars.

    Oh yeah, and you could easily have more than one talkcast a week. TalkShoe pays for that too.

    2. You want money for a defense attorney - what happened to paying off debt? Our society has public defenders for a reason. You don’t have a job: you can’t afford a defense attorney, or a cell phone, or a sweet car, or a computer. People work for wages so they can have these things.

    While these guys that you made agreements with are like vultures that came to the scent of your final (financial) last gasp, you’ve got to own up to agreements that you make with people. You don’t have any houses left, you don’t have any money left, you may not even have your marriage any more. It would be nice if you still had your integrity, because that is the one thing someone else can’t take from you. You can, of course, give it away yourself by making promises and signing contracts and then not following through on your commitments. Come on, Casey, it’s the one thing you could try to salvage and your giving it away again.

    These guys are businessmen, and they are misrepresenting their motiviations to sound more altruistic than they really are. (Are they really doing this for your wife’s benefit? Then they could be even more helpful by offering more money.) No, they’re offering you money because they believe they can make more than $20k with your web site, probably much more considering the risk that they’re taking. That doesn’t make it a bad alternative for you, though. If they can create more value with the web site than you can, then more power to them!

    What is the value of the website and domain after you quit? Very little. People are here to read your stories and comment on them. Very few people might be here to learn, and those people soon learn that this is an entertainment web site and not an educational web site. And when the entertainment leaves, there won’t be any reason to come here anymore. No more news stories will be written about you to draw people to this site, and no new links will be generated without some very creative work by the new owners.

    $20k is not bad, and this sounds like $20k guaranteed. The longer you wait, and as your exit date nears, the value is only going to fall. I can see you crawling back to them in a month, begging them to take your site for $5k. And they might say no.

    Do the right thing. Honor your commitment. Take the money and find closure.

    Your alternative is to lose the $20k offer, further ruin your relationship with your wife, lose whatever integrity you have left, and run this web site into the ground worthless.

    Why would you be dealing with Duane and LossMit for the next year? Aside from receiving 50% revenue, neither have asked you be be involved in the future of this website. In fact, it’s my impression that neither or them WANT you to be involved.

  • Changing your mind is not a valid reason to break a contract. If you have a valid contract with these folks (I mean something signed, whether you like its terms now or not), then you’d better respect it.

    Legally they have every right to come after you to get what you promised them. If they can’t, they will go after you for the value of what was promised. Which I believe means that they can even say although they wanted to buy the web site from you for $20k, they anticipated making $100k in profits, and you prevented that by unlawfully breaking the agreement. So they’ll come after you for $100k or whatever. Oh, you don’t have that much? Well, they’ll attach your paychecks (when you get a job) until they get their money.

    Get some legal advice, and honor your commitments.

  • It’s completely irrelevant whether you feel you’re on the up and up and the people you signed a contract with aren’t. The law is the law, and if you signed, you have to comply. That’s how people who get lousy credit card deals get screwed. That’s how people who get subprime loans get screwed. That’s how people who enter into bad marriages get screwed. You signed, you are liable. Sorry to be such a sour apple, but that’s the reality of the business world. It’s not their responsibility to make sure you get a good deal. It’s your responsibility to yourself to make sure you aren’t being screwed. It’s really too late after you’ve signed. Unlike your word, which seems to change at a moment’s notice, a handwritten contract binds you to fulfill your obligations whether they are “fair” or not. If you don’t, you go to jail. I doubt they’ll bother fining you since you don’t have any money. The judge isn’t going to care what’s “fair” or what’s the moral high road. They aren’t there to be your pastor or to be your advocate. That’s up to your lawyer. They are there to make sure the laws are executed to the letter, regardless of what you consider to be fair, moral, or friendly. If there is anything wrong with how you approach things it’s this unbelievable naivetee and gullibility you have that others will take your best interests at heart, even when they are total strangers. Learn to trust yourself, but keep in mind that the law is binding, and forget about what everyone else says. These are difficult lessons to learn, and I feel sorry for you doing it in public.

    What have you done to take care of yourself? Have you figured out what your worst case scenario is for pulling the plug on your contract? What the best case scenario is? How much risk is involved and what the pros/cons are to your decision? Have you thought things through? If you wait until you land in court, it’s far too late. Your choices will be completely irrelevant at that point.

    P.S. If you land in jail, you can forget about a W-2 job. The only people who will hire you are people who hire ex-cons. That’s by far your worst case scenario, I think, but it’s really up to you to decide.

    I am actually surprised I am writing this. It is more out of a sense of “fair play” than anything else.

    I do not know you personally, we will probally never meet, but from what you have written I do NOT agree with how you do business or treat your family and frankly do not like you much as a person.

    That being said, I do believe that you are in the process of being steamrolled by some very “clever” people.

    Some advice:

    Your blog: Your blog is only your thoughts and other peoples interaction with those thoughts. If you pull the content to another new site owned by another entity/someone else and leave a blank site with this domain it has a very quick declining value.

    Find a person with an exisiting blog who would like to monotize it/start a new domain w/ different ownership. post your new thoughts there. A site with ownership out of Nevada or Deleware would be best as they are very “legal” freindly states esp. to corps. Also, if you can pull off “pro bono” representation (see below) this will increase the costs of the other parties significantly.

    Book: Let the book deal go..who cares..book will not exactly be a best seller.

    Domain: Follow through on the deal for $20k if it is still on the table. Get everything in writing. Without seeing the terms of the agreement you signed it is hard to comment on this but I would feel there should be a way to keep those funds in escrow until you can renegotiate some of the funds to your legal defense. On a personal note, you should let G have the $20k after all the pain you have caused that poor lady.

    Legal counsel: You are in CA, the land of the “publicity w**** ” lol. If Kato can get a lawyer pro bono to work his case perhaps you can too. I do believe if you manage to procure legal representation pro bono most of the civil issues go away due to cost vs. return. Also, by following the above, you honor the contracts as I know them.

    G***** : If you ever have a chance you need to get her off the net and away from the guys involved in these deals. hands and knees begging is required here. Personally, I think she is better off without you, just my opinion.

    FBI: Who knows, if true you’re screwed.

    From now on you should refrain from any agreements, contracts, etc. You are obviously lost when it comes to business and really should get a W-2 job and live the rest of your life in relative obscurity.

    Shouldn’t we make it a common practice - think first and then act. Just teasing. Really good move KC. Some posts have mentioned restraining order against LMP dude; I believe one is the must to have. His moral and unbalanced character exposed through this blog has buried his business forever. Time to look for a W2 job? I guess just changing the name wouldn’t work - there always will be somebody watching. So, unless of course you are willing to keep covering his litigation expenses, I’m being worried for your life. You see, if you combine explosive character with damages this dude made to himself (blaming you as a medium) you may get something ugly. Just imagine if the fella who played the FBI prank doesn’t settle the matter with LMP and leak the info that LMP was involved (or knew about it and used it as a leverage in negotiations with you) it would almost certainly mean a jail time (with a bunch of charges like conspiracy to commit fraud, fraud itself, imposture as a fed agent and etc.). So, KC, be careful and really try to get the restraining order.

  • What a bunch of nonsense. Here’s what I do know:

    1) Casey conned his way into a bunch of property he could not afford, ended up in foreclosure and started this blog.
    2) Casey’s wife dumped him because he is a complete mess and treated her badly.

    Everything else is either a bunch of fiction or is being filtered through our very poor, possibly insane author until it is unrecognizable as fact. Then again, he might be crazy like a fox because the traffic is letting him sell advertising.

    There is no blog sale.

    There is no book publisher and there will be no book unless Casey pays to get it published (i.e. vanity publishing).

    There was no settlement with these various parties because there was nothing to settle. It is quite likely that these various other parties are invented characters or participants in Casey’s fiction.

    The whole deal seemed messed up from the beginning.

    But I had a feeling you had a change of heart with LMP and Duane since you saw how many people are interested in your story at the Capitol Garage! Cha-ching!!

    You have a chance to market yourself in public, selling books, and getting your face out there along with your story. I told Duane and LMP that you could do it, and that there is an opportunity. You can sell 5 or 10 or maybe 20 books each time you make a public appearance - who knows if it will work - but you are the type of guy who will try (we all know that!).

    Your main concern is the FBI investigation which will require money to protect yourself. I can see why you had a change of heart for only selling for $20K if you can get more. Sell the domain…save some for defense, use a few thou for G***** ’s bills to keep your word!

    I wish you luck, Casey. I don’t agree with everything you do, but I do agree that you have allow yourself a fighting chance in court - which takes money!!

    If I was in the middle of a deal and the other party did something like that, they could FOAD.

    Not knowing all the details, I’m not sure what you should do. But I would stop communicating with Mark and Duane in the least. Just cut them off.

    Try to unwind the deal with Marty best you can. At this point he’d probably walk away if it can be done with minimal loss.

    I would sell the url as soon as possible. I think you could do much better than what Duane was offering. Forget about revenue shares or anything but a straight up sale. Just the url. No content, continuing contributions, etc.

    I think these guys have you worked up over the FBI. I wouldn’t worry too much about it. I really can’t see any charges coming out of it. More likely they’re just checking things out because so many people have reported you.

    I think it’s a bad move to pay off any credit cards at this point. They’ve surely all gone into charge-off status. The damage is already done to your credit. Paid in full or settled for less, it’s not going to help your credit one bit at this point. Bankruptcy is inevitable so you might as well work in that direction. Your credit will improve faster with a bk than with settlements and debt counseling. I’ve seen people hit the 700s just 3 years after a BK7. Most of the damage is already done to your credit and it’s past unwinding.

    Bankruptcy would be the last suggestion if at all that I’d ever offer out. But in your case, with the debt load and all these other issues, it truly is your best choice.

    Forget these guys and the haterz drama. Focus on a steady income and devote your efforts to ending this mess.

    Let the guy sue you if he wants. It will end up costing him more than what it’s worth. His claims are flimsy anyway.

    It really doesn’t seem like he’s worked in your best interest. Rather it seems like he was trying to profit from you without any regard to you personally.

    Cut him off and sell the blog. Trust me, a few years of W-2 job and living a quiet non-public life will seem like a vacation to you after all of this.

Mismanaged, it will cause damage to you and your family as you are seeing. Managed well, there is a lot of potential. But you need to have your head on straight before you go attacking any future business deals.

  • I’m no longer that interested in Casey’s follies.

    What fascinates me is how many adult, professional people have gotten sucked so deeply into this vortex of madness. How come there are so many that have become totally consumed by this bizarre drama? What’s the attraction? This is a nice blog to visit twice a week - kind of like checking out Box Office Mojo on Mondays.

    But why would anyone actually get emotional about this? This site was like offbeat comic relief six months ago… then it took a darker turn when we realized how badly a lot of people were getting hurt… but now it’s an all-out freak show. The formerly peripheral persons are all of a sudden pushing to the center stage, revealing themselves to be just as unhinged as Casey.

  • I am interested in knowing more about your domain for sale. I am currently renovating a house that I am living in to sell for a profit. I won’t have cash to buy the domain for a couple months. If it is still available then, let me know.

    As for the “flipping” I am doing… It’s only working because it’s in a high demand neighborhood in a local market that is still growing. It’s a location that is very desirable, but the houses are old and small. So the added value is modernizing it and additional sq ft. so it would work for a family.

    What concerns me is that without all of the content, the search engine ranking will drop, because it’s part about content, not just links to get a high ranking. After you pull down the blog, shouldn’t you put some content relevant to foreclosures up and let it sit for a couple months, to see what would happen to the rankings?

  • No hatin’ here, Casey. Just sorrow. Sorrow for the pain you’re in (and the pain you’re going to be in) and sorrow for the pain you have caused. Mostly the latter, to tell you the truth.

    If you really want G back, you’ll have to win her back. And at this point, the only way to do that will be to change, and prove to her that you’ve changed.

    If I were you, here is what I would do:

    1. I would call/write her, and get down on my metaphorical knees. “G,” I would say, “I’ve been a complete and utter fool…”
    2. Then, I would CHANGE. I would do things that G wanted me to do. I would shut down the blog. I would get a W2 job. I would try to settle with my creditors.
    3. I would sell the domain now. I would make sure that money went to G in some way.
    4. After I had been working, full-time, for a year, and had agreements with all my creditors, and had been paying down my debt, then and only then would I go to G on my knees and beg her to take me back.

    I wouldn’t get my hopes up, though, because:

    If I were G:

    I wouldn’t take you back. Ever. You have to face up to the fact that you have hurt her. You have hurt her badly, Casey. If anybody did to me what you have done to G, I wouldn’t ever give them a chance to do it again. Even if she doesn’t take you back, she’s going to be climbing out of this godawful hole you dumped her in for a very, very long time.

    (It’s ironic, isn’t it: if I examine the situation rationally, the things I would do to win G back are pretty much exactly the things that you have already agreed to do. Maybe, just maybe, LMP and D really ARE trying to help?)

    I started out as a haterz. Then the whole Duane/LMP thing turned me off and made me started feeling bad for Casey. Now this latest turn of events and the revelation from Marty… Casey, you need to learn that you can’t enter agreements lightly!!! And if you do, you can’t just make it go away just because you don’t feel like it anymore! Oh, forget it. You’ve heard this like what, a few thousand times already?

    I have to admit, I didn’t think highly of Marty at first, with the plans for guru seminars, self-help material, and this previous “Adsense Code” book. But you know, thus far, I think he has been the most professional of Casey and the three stooges! He’s telling his side of the story, and that’s it. He has taken losses (just like all of Casey’s partners), but he’s not boasting of his legal prowess or threatening silly lawsuits, he’s not trying to “help” Casey or getting involved in Casey’s marriage, and he’s not squeezing blood from a turnip or scheming to get his grubby hands of any of Casey’s properties, what little there is left.

    The JV turned out to be a bad business deal, he’s cutting his losses, and moving on. I can see that this man has a real business he has to run and has better things to do than to co-star in a soap opera. Good for you, Marty!

    Serin tells us his focus on the blog caused stress for his wife and extended family.

    “I’m realizing money and fame is not worth a failed marriage,” he says, adding that he intends to focus on repairing relationships and “getting a regular W-2 job.”

    The news is bound to be viewed skeptically by the “haterz,” the name for the legion of blog-following Serin critics who say he misled financial institutions in securing loans for his ill-fated home purchases.

    They’re apt to point out that he closed the blog once before, only to reopen it weeks later.

    “I don’t expect people to believe me,” he says. “The only thing I can do is follow through this time.”

    This story is getting sillier every moment. You’re selling, you’re not selling. I just don’t see any rhyme or reason to anything you’re doing. I tend to think you’re being heavily influenced by others that have their own interests.

    You cannot fault anyone for acting in their own interest. But somebody has to think for Casey- and that should be Casey.

    There is this whole subtext of saving your relationship, but still think this is by no means certain by all these actions.

    You really should focus on maximizing the value of the blog, book, etc. If it is debt that is driving a wedge in your relationship, than maxing the value is the best way.

    It may be too much to ask that you actually make a plan of how to get the max value, but you would cut down on all this back and forth decisionmaking. Just a hint- changing your mind every day or so benefits no one.

    Correct. The average first time novelist gets paid about 4K as an advance. The author doesn’t pay to get published.

    Also, if Casey wanted to self-publish then he could have done the book through lulu.com and not have paid anything upfront at all. They make most of their money off of a commission on each book sold.

    However, if you want to get a UPC code so that you can sell on Amazon then they do charge an upfront fee of something like $150 (that’s one hundred, not one thousand) upfront.

    You design the the cover of the book, decided on what format you want (hard cover, paperback, comic book, whatever), upload the text and graphics, and start selling. The books can either be ordered directly from their site or you can set it up so that you handle the orders and forward the orders to their site.

    They even do CDs, DVDs, calendars, comic books, and photobooks, and they’re considered one of the few self-publishing companies to be completely above-board and legitimate.

    Too bad for Casey that Marty isn’t the same.

    Casey, screw Marty. He was trying to rip you off and you didn’t even know it. Sit down and write up your story yourself, then get a friend that’s not illiterate to edit it in exchange for “editor credit”.

    I know that the reason that you went with Marty was because he made it sound so easy for you. All you had to do was dictate a microphone and someone else would transcribe it and write it up for you. It was almost passive income. But it’s not working.

    Either do it the right way or give it up entirely. It’s obviously turned into more effort than if you’d written it yourself and had Kinko’s print the books up or something along those lines. These half-hearted efforts of yours are what cause all of your problems. Quit being so lazy.

    I hope you read this. Whether or not you choose to post it, I hope you read it.

    You’re boxed in, and I think you’re figuring that out. It’s not your fault; you made mistakes, and then everyone jumped in to kick a guy while he’s down. Now they’re coming in to finally finish you off.

    There’s no way to get out of this drama, so long as you’re wedged in between Duane, LMP, Marty, the FBI and the Haters. You’re not in a position to fight this out, and if you try, you’re going to be crushed. You have to know this. Not your fault, but you have to know better than fighting a suicidal battle.

    Your only real option now is tactical withdrawal, regrouping, and then reentering the battlefield on your own terms. It’s either that, or sitting and waiting for the FBI to land. That’s what you’re down to, Casey.

    Sacramento is about 500 miles away from the Mexican border. There’s no warrant out for your arrest right now, but that could change at any time - right NOW, you could get across the border as a free citizen of the United States. It’s unlikely that you’re such a priority to the FBI that they’d send a task force after you.

    If you left right now, you could be in San Diego by late tonight. Most likely, you could make it over the border, and then you’re golden for a while. There are plenty of places down there friendly to middle-class white young Americans, you’ll have almost a whole new continent to enjoy, and you’ll still have most of the tech conveniences you enjoy here. Every American dollar will go a lot farther in Mexico, and you’ll have the space you need to get yourself together.

    Don’t be stupid. You can’t win on these terms. Change the rules while you still legally can. Take a pleasure trip, visit lovely Mexico, regroup, and then come back and show everyone.

Contrary to popular myth, public defenders are often your BEST BET in a criminal proceeding (and the federal defenders’ office is a VERY competitive job to get.     I have a theory, but let’s see if you let this comment through (or god forbid, answer) first. If you do choose to answer, please note that my question is not addressing the amount of money. If you really want to help someone financially, just write them a check and be done with it.   • Remember, at the hearing, the burden of proof is on the plaintiff. Prepare yourself by bringing evidence that the plaintiff approached you and offered to provide services to you for “zip, nada, zilch”.

    Make sure you haven’t signed the “settlement”. Explain to the Judge that you have not been able to come to agreement on a settlement. That may be the end of this hearing and another date may be set for the suit to be heard.

    If not, present your evidence that the plaintiff interjected their self into your business affairs and began attempting to use the information you provided him in confidence to attempt to extort the business from you.

    Explain to the Judge that you have filed for a restraining order against the Plaintiff for civil harassment.

    Make clear to the Judge that the blog is your primary asset and source of income.

    The settlement with LMP stipulated how the proceeds were to be disbursed. Pay attention there, newbie! That would be the settlement THAT HE AGREED TO LAST WEEK.

    3. Casey is afraid of losing his Internet celebrity and returning the anonymous world of being a nobody.

    4. Casey found out his resume doesn’t qualify him for anything higher than a Best Buy greeter.

    Just a few quick suggestions….

    1.) Stop talking to The Characterz. No more emails, no more phone calls, etc.;

    2.) Stop talking *about* The Characterz; you got it out of your system, now move on and FOCUS;

    3.) Keep the blog going. It’s a nice little cash cow for you. Maybe spend a little less time on it, but keep it going, nonetheless;

    4.) Up to you, but maybe start looking for a W-2 job. It will provide a little stability, put some steady cash into your pocket, get some benefits (like health insurance), etc. It will also help you get your mind off stuff;

    5.) I’m not sure what sort of publisher is/was working on the Foreclosure Code… but if they’re not part of the “big boys,” then hook up with one! Seriously, hard-cover and/or paperback, with a national distribution capacity. You can make some serious $$$ on a REAL book (like something we can buy at Border’s, Amazon.com, Barnes & Noble, etc.). Your story WILL sell!!! To be honest, I’m not sure if there may be any legal ramifications of you profiting off such a book, but if it’s minimal to none, then DO IT, DUDE!!! None of this e-book stuff, you know? You need a real New York City kind of publisher. Maybe hook up with a (real) NYC literary agent to help you shop around? You’ll get a sweet advance upfront ($$$) and sweet royalties (passive income)!!!

    6.) As for your relationship with your Significant Other, not sure what to say there, as I don’t know the whole story, and is frankly none of my business. But what I will say, is that just keep cool, and try not to do anything too stupid, heh. Keep in mind that a marriage is not only a partnership — but also a legal agreement, as well… and can have legal ramifications. Be careful, man!

    Anyway, that’s about it for now. You’re on the right track. Now get out there and show the world what you’re made of. Take those lemons and turn them into LEMONADE!!!

    wow…. you display an uncanny ability to place yourself in stressful situations. I didn’t understand why you decided to sign the rights to your blog over to LMP/Duane. You need to face a couple of facts and plan your next steps based on them:
    1. G***** is gone. face it, whatever $ you send her way will not change that.
    2. You need to start looking after yourself, and yourself only. No one out there is looking after your best interests. Everyone has a motive for getting involved with you.

    This is about as interesting as watching a middle-school couple break up. (”I hate you; I’ll never go out with you again!” “No, please come back!”)

    Casey:

    1. You have an unhealthy addiction to blogging. I don’t mean that as an insult. But think about it. The internet in general is addicting. Emailing and instant messaging is addicting. Fame (regardless of the source) is addicting. Combine all three, as blogging does, and you’ve got a dangerous combination. You are so addicted to it you can’t let it go, even though it is ruining (has ruined) your life.

    2. You’re also a user. You used other people’s money (and credit) and flushed it down one rat-hole after another without the slightest thought of the real value of the assets you were buying or carrying costs. Hey, since it wasn’t your money, who cared? On the other hand, when it does involve your money (i.e. selling the blog), you are so anal reteintive that you can’t even follow through with commitments because you are afraid you didn’t maximize every dollar of value (i.e., selling something for less than it’s worth). If you’d showed that much care in using other people’s money, you never would have gotten in the mess you’re in.

    3. You are lazy. Real entrepreneurs work! They really work! They plan. They sweat the details. The build stuff. They provide services. They obsess over treating their customers right. The sweat every penny of every deal and run the numbers three times. You just borrow other people’s money and throw it away and think you’re an entrepeneur. Even your hero, Mr. Rich Dad, shyster that he is, had to sacrifice for years and learn the ropes of selling, business, finance etc. You are just looking for a magic bullet.

    Recognize your faults, face them, and maybe you can correct them. Putting it off to another day (i.e. 22 days from now, or whatever) isn’t going to do you any good. Your blog will wither and die within two months whether you pull the trigger or not. Better prepare for it. Good luck.

  • Casey, out of all the things that really bother me right now about all this, it’s got to be your own “wife’s” attitude toward you.

    I married my husband for better or worse, and believe me we had our worse several times over. He made his financial mistakes and paid for them, sometimes dearly, but by God he did learn from them eventually.

    He kept on trying to build his business because it was his dream, and because he wanted it and because I sincerely loved him, it was what I wanted too. I stuck by him every inch of the way.

    It’s now been years since I worked with him to help him build that business, and now we are millionaires several times over. He’s told me many times he could not have done it without my support and belief in him when it seemd that no one else would give him the time of day.

    If G can’t stick by you when you need it the most, then she doesn’t deserve to be there when you become successful.

    Dump G and find a good woman who won’t desert you during the hard times Casey. You’ll never regret it.

  • You know I would be willing to donate money to help G with her debt issues, but I am not interested in doing it through a site that might give CASEY or MARK or DUANE any access to the money. If it was set up by she or her family and it could be proven I’d be willing to donate. Casey won’t ever change and based primarily on what I’ve read and what I’ve heard them say in the talkcasts, I believe Mark and Duane are about as trustworthy as a Rolex dealer in Tiajuana.

    How in the world you ever got involved with those two individuals is beyond me. I’m guessing they dangled a shiny object in front of you and you went for it. In my opinion it is highly unprofessional for a publisher to be airing dirty laundry on their website about you. There is a proper time and place for this and it’s in our court system. Given that the situation has degraded to such a toxic level, I really hope for your sake that you’ve got a lawyer and strongly advise you let the lawyer deal with them through the legal system.

    By the way if the website does eventually get transferred to one of these individuals, please delete my email address, IP address plus any info on me from your system. I want nothing to do with those people.

    Why does everyone keep saying that Casey broke some court settlement. No judge has seen this settlement, much less approved this settlement. The other party to the suit has not seen or approved the settlement. Fair ball.

    What Mark needs to be worried about when he walks into court, is explaining why he was involved in a settlement that involved transferring assets of somebody that was under the investigation of the FBI. Sorry Mark, we both know that the judge didn’t know, but you did.

    1. You are not a non-profit, funds collected are not donations… it is a gift and is subjected to income tax/gift tax.

    2. Casey will need to pay tax on the distributions also as income.

    3. You are seeking a 15% Administrative fee.

    4. The site listed no means of verification for management and distribution of funds.

    1 (30%) + 2 (20%) + 3 (15%) = 65% “skimmed” off the top before the funds gets to where it needs to go. This means only 35 CENTS for every dollar gets to Casey’s cause.

    (Unless you never intended to pay income tax… in which case, whoever owns that particular PayPal account is going to be in a heap of trouble with the IRS for TAX EVASION… which definitely comes with jail time. (Don’t forget, the FEDS are watching Casey right now… Are you sure you want to jump into that pile of mess?))

  • Here’s what a 664 motion entails in Calif, I guess 664.6 is of particular interest:

    664. When trial by jury has been had, judgment must be entered by
    the clerk, in conformity to the verdict within 24 hours after the
    rendition of the verdict, whether or not a motion for judgment
    notwithstanding the verdict be pending, unless the court order the
    case to be reserved for argument or further consideration, or grant a
    stay of proceedings. If the trial has been had by the court,
    judgment must be entered by the clerk, in conformity to the decision
    of the court, immediately upon the filing of such decision. In no
    case is a judgment effectual for any purpose until entered.

    664.5. (a) In any contested action or special proceeding other than
    a small claims action or an action or proceeding in which a
    prevailing party is not represented by counsel, the party submitting
    an order or judgment for entry shall prepare and mail a copy of the
    notice of entry of judgment to all parties who have appeared in the
    action or proceeding and shall file with the court the original
    notice of entry of judgment together with the proof of service by
    mail. This subdivision does not apply in a proceeding for
    dissolution of marriage, for nullity of marriage, or for legal
    separation.
    (b) Promptly upon entry of judgment in a contested action or
    special proceeding in which a prevailing party is not represented by
    counsel, the clerk of the court shall mail notice of entry of
    judgment to all parties who have appeared in the action or special
    proceeding and shall execute a certificate of such mailing and place
    it in the court’s file in the cause.
    (c) For purposes of this section, “judgment” includes any
    judgment, decree, or signed order from which an appeal lies.
    (d) Upon order of the court in any action or special proceeding,
    the clerk shall mail notice of entry of any judgment or ruling,
    whether or not appealable.
    (e) The Judicial Council shall, by January 1, 1999, adopt a rule
    of court for the purposes of providing that, upon entry of judgment
    in a contested action or special proceeding in which a state statute
    or regulation has been declared unconstitutional by the court, the
    Attorney General is promptly notified of the judgment and that a
    certificate of that mailing is placed in the court’s file in the
    cause.

    664.6. If parties to pending litigation stipulate, in a writing
    signed by the parties outside the presence of the court or orally
    before the court, for settlement of the case, or part thereof, the
    court, upon motion, may enter judgment pursuant to the terms of the
    settlement. If requested by the parties, the court may retain
    jurisdiction over the parties to enforce the settlement until
    performance in full of the terms of the settlement.

    664.7. (a) Notwithstanding Section 664.6, if parties to a pending
    construction defect action stipulate personally or, where a party’s
    contribution is paid on its behalf pursuant to a policy of insurance,
    the parties stipulate through their respective counsel, in a writing
    signed by the parties outside the presence of the court or orally
    before the court, for settlement of the case, or part thereof, the
    court, upon motion, may enter judgment pursuant to the terms of the
    settlement. If requested by the parties, the court may retain
    jurisdiction over the parties to enforce the settlement until
    performance in full of the terms of the settlement.
    (b) It is the intent of the Legislature that this section modify
    the holding of Levy v. Superior Court (1995), 10 Cal. 4th 578,
    regarding the authority of counsel in a construction defect action to
    bind a party to a settlement.
    (c) For purposes of this section, “construction defect action”
    shall mean any civil action that seeks monetary recovery against a
    developer, builder, design professional, general contractor, material
    supplier, or subcontractor of any residential dwelling based upon a
    claim for alleged defects in the design or construction of the
    residential dwelling unit.

  • I wonder why a big business man would bother suing you. He’s got to be losing 1k or more per day just by being distracted from his real work. So he wants no more that 10k? It doesn’t seem like it would be worth his time.

    So I assume it is out of spite or worse. Why would a grown man/men have so much interest in you. It’s just creepy. Why would they get so emotionally involved?

    Now, more than ever, you need to file for bankruptcy.

    Bankruptcy does a lot more than address your debts - it can also allow you to avoid these transfers if you got less than fair market value (which you did) and keep crazy people (not just creditors) from pursuing you (which they are).

    It will also require that the Court approve any other major assets transfers, which should save you from yourself.

    If you spoke with a real bankruptcy attorney before, ask him how it could help you now.

    I’m in the UK, I posted before because I have a publishing company. You have been through this living nightmare for the last how long? And now when you’re at the point where you could actually make some real money - the very thing you’ve been trying to do all along - with the book & the blog, you prepare to throw it all away, firstly by giving away the rights to the book for nothing, & selling the blog for peanuts (If I were a psychologist I’d think that you want to fail, like you are afraid of succeeding).

    You may not have noticed, but Bear Stearns today announced that their hedge funds heavily weighted with subprime mortgage securities are almost worthless - from $1.5 billion to around $90 million. What that means is a recession & that there are going to be the biggest amount of forecolsures that have ever been seen. How much will your blog & story be worth then?

    You need to be able to think clearly (your life seems to be a jumbled mess - no wonder you can’t think straight) so you need to do the following:

    1) Get yourself a GOOD attourney. I have had people aggressively threatening me & my business for frivolous legal reasons, & they are BIG names & worth millions of dollars - my business is tiny by comparison. However, all that they were doing was trying to scare us into submission. As soon as my legal representative (a friend in the legal profession who represented us for free) threatened them it put the sh*ts right up them - I could then forget about it all & get on with my life because I knew that he was dealing with it & he knew what he was doing. In the end the big boys were the ones to back down to me!

    2) Speak to your wife & see what she intends to do. I’m sorry to say it but at least one of those guys seems to be trying to screw you around & getting you to p*ss off your wife so that he can slide in there. If she has no intention of a future with you then let it go & put it down to experience & you can then think more clearly about what you’re going to do.

    3) Get things back on track with your publisher or find a new one - the book could be huge & will make you quite wealthy if you play it right - its time to start being a businessman & not just talk about trying to be one whilst playing nickel & dime games.

    4) Think about the impending problems in the real estate markets & how you can position your blog &/or any other products to benefit from it whilst helping other people - this too could make you very wealthy.

    5) Finally, don’t forget who gave you this advise & be sure to send me a generous check for my consultation :)

    Get on with doing what you’ve always wanted to Casey, take this opportunity & turn it into cash - you won’t get another chance like it.
